Contract Form - Commercial Photography Agreement

This form of Commercial Photography Agreement is designed to facilitate both one-time and ongoing photography arrangements between a photographer and a commercial client. The Agreement is drafted with the photographer’s interests in mind, not only with respect to the protections afforded by its provisions, but also with respect to its versatility. One of the ways this form of Agreement is versatile is by employing a mechanism that incorporates by reference the specific details of each event / deliverable (e.g., fees, expenses, locations, number of images, etc.) through the use of one or more separate “Orders.” The Order can be a formal document signed by both parties (an example of such an Order is included as Exhibit A to the Agreement), or it can simply be a mutually acknowledged email (or even text message) exchange that references the Agreement. In other words, this form of Agreement is designed to accommodate the way photographers actually work and communicate with their commercial clients.
